College anti-Israel agitators could be sent to Gaza under new House GOP bill

A new House Republican bill would send any person charged and convicted for illegal activity on a college campus to Gaza for at least six months.

Rep. Andy Ogles, R-Tenn., introduced the bill on Wednesday alongside Reps. Randy Weber, R-Texas, and Jeff Duncan, R-S.C., in response to the ongoing anti-Israel demonstrations on college campuses across the country.

Several of those protests have turned violent, with clashes between police and activists, as well as [thousands] of activists being arrested across multiple campuses.

The bill is clearly intended as a troll, but regardless -- its a proposed as a bill that would become a law only if enacted by both houses of Congress and signed by the President; the law wouldn't do away with trials before a neutral judge; Gaza is not Siberia; and there's no kill list.

What's part of the Constitution is violated? Is there something in the Constitution that provides those convicted of crimes must serve a sentence in the United States? Its not express right in the Constitution, its certainly not an unenumerated right contained in the 9th Amendment reserved to the people as there is no longstanding common law tradition to not serve sentences extraterritorially. (Otherwise we wouldn't have Australia. Or Georgia (the state, not the country) for that matter.) Cruel and unusual punishment prohibited by the 8th Amendment? Possibly, but you see Per, that's part of the troll.

Now, I'm not a legal scholar, but from what I understand it seems to be the 14th amendment:
Natural-born U.S. citizens maintain citizenship through the 14th Amendment, so they cannot be denaturalized or deported

I tried to look at the actual wording of the 14th amendment, but I don't really see where it says so, but numerous sites claim that because of that amendment, natural born US citizens cannot be deported, and naturalized citizens can only be deported if they received their citizenship on false grounds, and have their citizenship revoked. I guess it may have to do with how courts have interpreted the amendment rather than the explicit wording.

In my understanding, being sent abroad because of a felony or misdemeanor would constitute deportation.

Australia and Georgia were British penal colonies and would have little to do with US laws and/or citizenship rights.
British subjects in the 18th century did not have the same rights and protections as US citizens in the 21st (or even 19th) century.

And of course the Soviet Union deported its citizens left, right and center.
They never were sticklers for citizens' (or even human) rights. :|
