Interesting, I wonder if they said you agreed to be paid X$ but for that you have to Y deliverable to get paid. You didn't meet the expected deliverable thus you breached the contract and we are terminating it.

Don Sweeney makes another shrewd move and trades a 3rd rounder for Z. Rinaldo.

Kings director of VP of hockey ops/player personnel Mike Futa was on The Fan 590 in Toronto on Monday morning. The meeting in Kenora was in reference to the previous summer.
"(Dean Lombardi) flew into Kenora and looked Mike in the eye and felt it was comfortable we were going to have him buy in a little bit better, but it just didn’t work out…He’s the one who’s got to look in the mirror in regards to his decision.”

Ryan Kennedy @THNRyanKennedy
Viktor Tikhonov will narrow his free agency choices down to five teams by tomorrow night.
27 yrs old, 6'2, 185lbs - C/RW - Tikhonov is a forward with fine offensive ability. He has good hockey sense and skates really well. Can both make plays and finish them himself. Has solid defensive acumen and the ability to play both wing and center.
- Ulf Andersson, EP -

Couldn't happen to a nicer team.

So a material breach is vague
14. The Club may also terminate this SPC upon written notice to the Player (but only after obtaining Waivers from all other Clubs) if the Player shall at any time:
(a) fail, refuse, or neglect to obey the Club's rules governing training and conduct of Players, if such failure, refusal or neglect should constitute a material breach of this SPC.
b) is refusal of services which doesn't seem to apply.
So I guess we can assume he failed or refused to follow team rules of conduct in some fashion. Serious enough that they resort to material breach. I'm guessing an off ice conduct issue but it has to be more than drugs or alcohol because the league has a substance abuse program that must be followed. Unless he refused to go into a treatment program??
Let's look at similar situations. Vic had his contracted voided in the NFL for the dog fighting scandal. Voynov is under suspension but should he be convicted on his domestic violence charge they will use the material breach clause to vitiate his contract. Someone in the NBA years back was breached for a gun possession charge. I'm sure there are many other examples.
My reading of the CBA is that Richards has the right to an arbitration hearing with the Commisioner. Gotta believe the Kings would have run this by the NHL's legal department first. Gotta say, if he f%%ked up good on the Kings for doing this. The Flyers obviously saw these problems and could not get Richards and Carter out of there fast enough.
Let the rumours fly.

The LA Twitter nerds are saying WOW, major, it will blow people away sorta thing. Maybe someone had unprotected anal sex? Naw, that wouldn't blow people away, well maybe Americans it would.
It could be just all the drug rumours and he has refused treatment, that would be a breach but then it is usually the NHL that suspends under its substance abuse program. Maybe he is refusing to follow a fitness/nutrition plan. Naw that's not major. Hard to say.
Aaron, shut the fuck up!!!

Lol HW
Well, if domestic violence and meth & blow isn't a breach, it must be unprotected anal sex.

Well he may have more serious issues to face if that's the case. Not hard to imagine that he was likely caught bringing something into Canada or the U.S. That he shouldn't have been, good on LA for ending all trade talks when they found out.
I laughed when I read that the cap recapture penalty would still apply.
