You cannot legally stand in the middle of the road and record. You cannot legally direct traffic around an ongoing police situation.

You cannot legally insert yourself between law enforcement and a suspect/person they are apprehending.

So was he legally recording? Yes. Was the place he was doing it legal? Negative.
